These GTC apply to all contracts concluded between Hatcat OÜ (Registration number: 16286332, Vesivärava tn 50-201, 10152 Tallinn, Estonia) and the Customer via the online shop. By placing an order, the Customer accepts these GTC.
The presentation of goods in the online shop is not a legally binding offer, but a non-binding online catalogue. The Customer's order constitutes a binding offer to purchase the goods. The contract is concluded when Hatcat OÜ confirms acceptance of the order in a separate email (Order Confirmation).
3.1. All prices are indicated on the website and include Value Added Tax (VAT), where applicable.
3.2. Payment must be made using the payment methods offered during the checkout process. Hatcat OÜ uses a third-party payment service provider (NoPayn/Rapyd) to process payments. The Customer agrees to the payment terms set by said provider.
3.3. In the event of payment default, Hatcat OÜ reserves the right to charge default interest.
4.1. Delivery shall be made to the address specified by the Customer. Stated delivery times are approximate.
4.2. The risk of loss or damage to the goods passes to the Customer upon physical transfer of the goods.
4.3. Given the technical nature of ESS systems, the Customer is solely responsible for arranging qualified, professional installation. Hatcat OÜ is not liable for damages resulting from unprofessional installation.
The Customer's right of withdrawal and the return procedure are governed by the separate Return, Exchange, and Cancellation Policy published on this website, which is an integral part of these GTC.
6.1. The statutory warranty provisions of the European Union apply.
6.2. Hatcat OÜ provides a separate 1-year product warranty for ESS systems, the terms of which are enclosed with the product.
6.3. Hatcat OÜ is liable for damages only in cases of intent or gross negligence. Liability for damages resulting from unprofessional installation or improper use of the ESS system is excluded.
7.1. Applicable Law: The laws of the Republic of Estonia shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
7.2. Place of Jurisdiction: The exclusive place of jurisdiction for all disputes arising from this contract is Tallinn, Estonia, provided the Customer is a merchant or a legal entity under public law.
7.3. Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
